Grand Jury Indicts Two For Murder, Evidence Tampering In Oklahoma Indian Country
On Friday, the U.S. Attorney for the Northern District of Oklahoma announced a series of November Grand Jury indictments, including new drug and evidence charges for Justin Wade Malone, 38, and Devon Marie Larocca, 38 of Tulsa related to the July 2022 murder of Cristian Amaya Hernandez.
The case is considered within Indian Country because the murder took place within the land historically belonging to the Muscogee Creek Nation. Malone is a member of the Cherokee Nation.
Malone confessed to the murder to officers when arrested.
Lorocca and Malone, who were first indicted by a grand jury in August, have now been indicted for an extended list of charges related to the murder, including intentionally removing weapons belonging to both men from the scene, removing security cameras and deleting surveillance videos.
In the affidavit submitted by FBI Special Agent Laura Tuteral in July, Tuteral describes accounts from Tusla police, Larocca and a cooperating witness that allege Malone got in an argument with Hernandez before shooting him in the head and leaving the scene.
Devon Larocca, described in the complaint as the victim’s girlfriend, described Malone shooting Hernedez to police after the incident but has been indicted herself for her role in aiding and abetting the murder after the fact.
The pair are also being charged with possession of illegal drugs at a Tulsa residence with the intent to distribute. Methamphetamine and fentanyl recovered at the residence were allegedly for distribution and use.
Additionally, Daniel Christopher Edwards, the man charged with the October molotov cocktail attack of a Tulsa Church was indicted for multiple counts related to his attack at the church and his assault of a church staffer with a sword.
The District also announced Grand Jury indictments in another Second Degree Murder in Indian Country charge case, one case of attempted murder and one case of stalking with the intent to kill.
