Over Half of Illinois State’s Attorneys File Lawsuits Against Bail Reform
The attorneys claim that the recently passed SAFE-T Act, which eliminates cash bail in most cases, is unconstitutional and a threat to public safety.
Over half of the 102 State’s Attorneys in Illinois have filed lawsuits against the SAFE-T Act, which among other things, eliminates cash bail except in the instance that someone is deemed either an immediate threat or a flight risk and that they say is both unconstitutional and a threat to public safety, reports Nina Burns for WQAD. Knox County State’s Attorney Jeremy Karlin argues that cash bail is specifically mentioned in the state’s constitution, that the SAFE-T Act, which takes effect in 2023, doesn’t adequately take into account the rights of victims, and that, because of its poor wording, implementation of the statute is going to look different in every county. He added that there are plans to consolidate all lawsuits into one.
