While simply running for president doesn’t shield Trump from prosecution, which one expert said would mean anyone could then run for president to avoid the law, it creates a uneasy political context that could benefit him in the proceedings. DOJ officials have considered a special counsel to keep the investigations shielded from political bias moving forward, but U.S Attorney General Marrick Garland has not made a call yet.
