Ohio Supreme Court Overrules Cap On Damages For Child Sexual Abuse Victims

The Ohio Supreme Court decided Friday that damages for child victims of sexual abuse cannot be capped. Under the ruling, caps on “noneconomic damages” cannot be applied to young victims who “suffer traumatic, extensive and chronic psychological injury” and sue their abusers for civil damages, Susan Tebben reports for the Ohio Capital Journal

The court’s majority determined the cap on damages was unconstitutional when applied to children in sexual abuse cases because it works contrary to the constitutional guarantee of due course of law.
